Official Rules
PLAYABLY REBATE PROMOTION
NO PURCHASE NECESSARY TO ENTER OR TO RECEIVE THE CONTINGENT REBATE. A PURCHASE WILL NOT IMPROVE YOUR ELIGIBILITY.
VOID WHERE PROHIBITED BY LAW.
EXCEPT AS EXPRESSLY STATED IN THESE OFFICIAL RULES, AND EXCEPT FOR OUTERSEAS TO THE EXTENT IT PARTICIPATES AS THE SELLER, ADVERTISER, CONTRACTING PARTNER, OR CO-ADMINISTRATOR OF THE PROMOTION, THIS PROMOTION IS NOT SPONSORED, ENDORSED, ADMINISTERED BY, OR AFFILIATED WITH THE NATIONAL WEATHER SERVICE, FACEBOOK, INSTAGRAM, OR TIKTOK.
OFFERED ONLY TO LEGAL RESIDENTS OF THE UNITED STATES, AGE 18 OR OLDER.
If 3 inches (7.6 cm) or more of snowfall is recorded by the National Weather Service at Central Park, New York, on December 25, 2026, each eligible entry will qualify for the Contingent Rebate described below. No purchase is necessary to enter or receive the Contingent Rebate, and a purchase will not improve an entrant's eligibility or chances of receiving it. See these Official Rules for the Trigger Event, entry methods, deadlines, verification requirements, and rebate limits.
1. PROMOTION PERIOD: Playably, Inc. ("Sponsor" and administrator) is offering the "Outerseas White Christmas Promise" Promotion (the "Promotion") beginning at 12:00 AM on November 27, 2026 and ending at 11:59 PM on December 11, 2026 (the "Promotion Period"). All times are Pacific Time (PT).
The Promotion ends at the earliest of: (a) 11:59 PM PT on December 11, 2026; or (b) the Cutoff Date described in Section 3. If the Promotion ends early, Sponsor will deactivate any promotion code as promptly as practicable and post a notice on the Promotion page, and no entry made after that time is eligible. Entries validly made before that time remain subject to these Official Rules.
Sponsor is responsible for administering the Promotion in accordance with these Official Rules and applicable law, including determining eligibility, valid entries, the Trigger Event, verification, and claims.
For purposes of these Official Rules: (a) "Promotion" means the consumer promotion described here; (b) "Official Rules" means these written rules; (c) "AMOE" means the alternative method of entry described in Section 3; (d) "Trigger Event" means the specific event outcome identified in Section 3; (e) "Approved Event Source" means the official source identified in Section 3; (f) "Event Data" means the source data used to determine whether the Trigger Event occurred; (g) "Contingent Rebate" means the refund, payment, or equivalent benefit payable only if the Trigger Event occurs and the claim is verified; (h) "Eligible Transaction" means a purchase satisfying Section 3; (i) "Prize" means any gift card or other award separately identified as a prize; (j) "Prize/Rebate Funding" means the amount designated to fund the stated Prizes and Contingent Rebates and is not a limitation on a valid claim unless expressly disclosed; (k) "Entrant Data" means information submitted or collected in connection with the Promotion; and (l) "Participating Consumer" means an eligible person with a valid entry or Eligible Transaction.
2. PROMOTION ELIGIBILITY: The Promotion is open only to natural persons who are legal residents of the fifty (50) United States and the District of Columbia, are at least eighteen (18) years old (or the age of majority in their jurisdiction of residence, if higher) as of the date of entry, and are not prohibited from participating by applicable law. The following persons are not eligible: Sponsor; Outerseas; any Approved Event Source, league, team, school, or other event participant; Sponsor's and those entities' parents, subsidiaries, affiliates, advertising and promotion agencies; and each of their respective employees, officers, directors, representatives, and agents, together with their immediate family members and members of the same household (whether related or not). Void where prohibited or restricted by law. Sponsor may verify eligibility and will make eligibility determinations subject to applicable law.
3. ENTRY METHODS; EQUAL TREATMENT: Eligible consumers may participate by either entry method below. No purchase, payment, or other consideration is required to enter or to have a chance to receive the Contingent Rebate. Each valid entry is subject to the same eligibility criteria, Trigger Event determination, claim deadline, verification standards, and opportunity to receive the stated benefit for that entry method, as described below. A purchase will not improve an entrant's chances or otherwise affect the outcome.
Entry Method 1 - Eligible Transaction: During the Promotion Period, complete one Eligible Transaction on outerseas.co using code WHITEXMAS. The transaction must be completed by the entrant for personal use, paid in full with an authorized payment method, and not be returned, refunded, canceled, charged back, disputed, or purchased for resale. One Eligible Transaction may generate only one entry. The purchase price used to calculate a Contingent Rebate excludes taxes, shipping, handling, fees, discounts, credits, and gift cards unless expressly stated otherwise.
If the Trigger Event occurs, each Participating Consumer with a valid entry is eligible to receive one Contingent Rebate. For an Eligible Transaction, the Contingent Rebate equals 100% of the net purchase price up to $150. For an AMOE entry, the Contingent Rebate is a cash-equivalent benefit equal to the average value of redeemed rebates through the purchase method. If the Trigger Event does not occur, no Contingent Rebates will be awarded. Limit one (1) entry and one (1) Contingent Rebate per person and per household, regardless of entry method.
ENTRY CAP; PURCHASE ALLOCATION; AMOE RESERVE: The Promotion is limited to a total of [TOTAL ENTRY/REBATE CAP] entries and Contingent Rebates. Sponsor reserves a portion of that total cap for AMOE entries (the "AMOE Reserve") equal to [AMOE RESERVE NUMBER OR PERCENTAGE], based on a reasonable estimate of expected AMOE entries. The remainder of the total cap is available for Eligible Transaction entries (the "Purchase Allocation"). Subject to the existing one-entry-per-person-and-per-household limit, purchase entries will be accepted on a first-come basis until the Purchase Allocation is reached or the Promotion Period ends, whichever occurs first. Once the Purchase Allocation is reached, Sponsor will stop accepting purchase entries and will promptly stop advertising further purchase entries. AMOE entries postmarked by the AMOE postmark deadline and received by the AMOE receipt deadline remain eligible up to the AMOE Reserve, even if the Purchase Allocation has already been filled, so that a timely no-purchase entrant is not disadvantaged by purchase volume. The total number of Contingent Rebates will not exceed the total cap. Entries beyond the applicable allocation or reserve are not eligible, subject to the equal-treatment and no-disadvantage provisions of these Official Rules and applicable law.
TRIGGER EVENT; MEASUREMENT: The Trigger Event occurs only if 3 inches (7.6 cm) or more of snowfall is officially recorded for Central Park, New York, on December 25, 2026, as the total snowfall for that calendar day in Eastern Time. Sponsor will determine the Trigger Event solely from the Approved Event Source: the National Weather Service's Daily Climate Report for Central Park, New York, for December 25, 2026 (forecast.weather.gov/product.php?site=OKX&issuedby=NYC&product=CLI), with the NOAA National Centers for Environmental Information record for the Central Park station used only if the primary source is unavailable. Event Data means the source's official record of the relevant result, score, statistic or other measurement designated by Sponsor. The following adverse-event and correction rules apply: If no final result is published, the Trigger Event will be deemed not to occur.
CORRECTION RULE: If the Approved Event Source later corrects a result: the official result as it stands 48 hours after the event ends controls, and a correction published after that time does not change the Trigger Event determination.
An Eligible Transaction must remain in good standing through payment of the Contingent Rebate. If the transaction is returned, refunded, canceled, charged back, disputed, or otherwise reversed before payment, it is not an Eligible Transaction and no Contingent Rebate is owed. If a return, refund, chargeback, or reversal occurs after payment, Sponsor may seek repayment or offset the Contingent Rebate to the extent permitted by law. A return requested after the Trigger Event does not create a second benefit or alter the Trigger Event determination; the Brand's ordinary return policy applies. Nothing in these Official Rules waives a consumer's non-waivable refund, return, or statutory rights.
Entry Method 2 - AMOE: No purchase is necessary. To enter without an Eligible Transaction, mail a post card in a stamped envelope to Playably, Inc., 3242 Lincoln Ave, Honolulu, HI 96816 postmarked by December 11, 2026 and received by December 16, 2026, containing the following information. No third-party entry service, photocopy, computer-generated or automated entry, or bulk mailing is permitted, except that an entrant with a disability may use assistive technology, an accessible format, or necessary assistance to prepare, complete, or mail an entry, provided that the technology, format, or assistance is used solely to address the entrant's disability and does not circumvent the one-entry limit. Limit one entry per outer mailer
- Full Name
- Mailing Address
- Email Address
- Telephone Number
- "Outerseas White Christmas Promise" and a statement confirming the entrant is at least 18 years old and of the age of majority in their jurisdiction(s) of residence
Each valid AMOE entry will be treated as one entry under these Official Rules and, if the Trigger Event occurs, will qualify for the AMOE Contingent Rebate value stated in this Section 3 (the average value of redeemed rebates through the purchase method) and the same payment method available to a purchase entrant, subject only to purchase-specific verification requirements that do not apply to an AMOE entry. If the Trigger Event does not occur, no Contingent Rebate will be awarded.
The entry must be completed by or on behalf of the entrant, who must be an eligible individual. An entrant with a disability may receive necessary assistance to prepare or submit the entry, including assistance using assistive technology or an accessible format. No commercial third-party entry service or automated or mass entry is permitted. Each postcard must be mailed separately in a stamped envelope. Sponsor is not responsible for late, lost, damaged, illegible, misdirected, postage-due, or incomplete mail. Limit one (1) AMOE entry per person and per household, subject to the total entry limit in these Official Rules.
Accessible Entry. An entrant who, because of a disability, cannot enter by the methods above may request a reasonable accommodation or use an alternative accessible entry method by contacting Sponsor at support@playably.ai or [ACCESSIBLE ENTRY PHONE NUMBER] before the applicable entry deadline. Sponsor will provide an equally accessible method of entry at no cost and will treat any resulting entry as one valid AMOE entry on the same terms as any other entry, including the same AMOE Contingent Rebate value, Trigger Event determination, verification requirements, claim deadline, and opportunity to receive the Contingent Rebate. Any accessible or accommodated entry remains subject to the one (1) entry per person and per household limit and will not be disadvantaged based on the method used.
A person may use either entry method but may not exceed one (1) total entry per person and per household. If Sponsor receives multiple entries, including an Eligible Transaction and an AMOE entry from the same person or household, Sponsor will count only the first valid entry received based on its records, and later entries are void. The entry method used will not affect eligibility, the Trigger Event determination, or the opportunity to receive the Contingent Rebate; the value of the Contingent Rebate for each entry method is stated above.
All Eligible Transactions must be completed by 11:59 PM PT on December 11, 2026. AMOE postcards must be postmarked by December 11, 2026 and received by December 16, 2026. Sponsor may disqualify any person who uses false information, multiple identities or households, automated means, fraudulent or reversed transactions, altered materials, or any method intended to obtain more entries or benefits than permitted. Sponsor's reasonable administrative decisions are final, subject to applicable law. Entry information will be used to administer the Promotion and is subject to the Privacy Policy; it does not become Sponsor's exclusive property merely by submission. Proof of mailing or transmission is not proof of receipt.
If the Purchase Allocation is reached before 11:59 PM PT on December 11, 2026, the Promotion Period and the AMOE postmark deadline will end on the date the Purchase Allocation is reached (the "Cutoff Date"), and Sponsor will post the Cutoff Date on the Promotion page as promptly as practicable. AMOE entries postmarked on or before the Cutoff Date and received by five (5) days after the Cutoff Date will be included in the Promotion, up to the AMOE Reserve and subject to the one-entry-per-person-and-per-household limit.
4. REBATE TERMS; CLAIM DEADLINE: If the Trigger Event occurs, Sponsor will send operational notice to the email address or other contact information associated with the entry or Eligible Transaction. To claim the Contingent Rebate, the Participating Consumer must complete and submit the secure claim form at [CLAIM URL] within forty-five (45) days after the date Sponsor sends the notice. The claim form will request only information reasonably necessary to verify eligibility and deliver the Contingent Rebate, such as proof of purchase for purchase entrants, proof of identity, age and residence, and a payment-account identifier. Sponsor will not request a password, PIN, or login credential.
Claimants are responsible for submitting accurate and complete information and any reasonably requested documentation. Failure to timely complete the claim or satisfy verification requirements may result in forfeiture, subject to any legally required cure period. Approved Contingent Rebates will be paid within thirty (30) business days after Sponsor receives and verifies complete claim materials, using PayPal or Venmo. If a Participating Consumer cannot receive payment by PayPal or Venmo, Sponsor will offer an alternative payment of equal value on request. Payment-provider terms, account limits, fees, delays, and technical issues may apply; Sponsor is not responsible for provider conduct beyond its reasonable control. Sponsor may request an IRS Form W-9 or other tax documentation only if required by law. Any tax or reporting obligation relating to a Prize or Contingent Rebate is the recipient's responsibility to the extent required by law. No publicity consent is required to receive a Contingent Rebate or Prize.
Sponsor is not responsible for errors, omissions, delays, or failures in communication or transmission, including incorrect or incomplete contact information supplied by an entrant, spam filters, network issues, or delivery problems beyond Sponsor's reasonable control. If a notice is returned or undeliverable because of information supplied by the entrant, Sponsor may deem the claim forfeited after reasonable efforts.
Sponsor may disqualify a claimant if the claimant: (a) fails to provide required information or documents within the applicable period; (b) submits false, altered, incomplete, or misleading information; (c) uses an ineligible, reversed, or disputed transaction; or (d) fails to comply with these Official Rules. Sponsor may request additional reasonable documentation to confirm eligibility and prevent fraud.
5. NO RANDOM DRAWING; TRIGGER EVENT DETERMINATION: No random drawing is used to determine Contingent Rebate recipients. All valid entries are eligible on the same terms, and each valid entry receives the Contingent Rebate only if the Trigger Event occurs and the entrant satisfies these Official Rules. Because no drawing is used, no odds of winning apply. If Sponsor later elects to offer a separate Prize drawing, these Official Rules must be revised before the Promotion begins to state the number, value, approximate retail value, eligibility, entry method, drawing date, and odds. Whether any entrant receives a Contingent Rebate depends solely on whether the Trigger Event occurs. The likelihood of that outcome cannot be calculated in advance and is not affected by the entry method, purchase amount, or the number of entries. If the Trigger Event occurs, every valid entry within the applicable entry cap receives the Contingent Rebate; if it does not, no entry does.
6. REBATE VALUE; PRIZE/REBATE FUNDING: Before launch, Sponsor must state the value or formula for each Contingent Rebate, the maximum value per recipient, and any total Prize/Rebate Funding: 100% of the net purchase price of the Eligible Transaction (excluding taxes, shipping, handling, fees, discounts, credits, and gift cards), $150, and [TOTAL PRIZE/REBATE FUNDING, IF ANY]. Sponsor will honor each valid, timely, verified claim up to the stated amount and will issue an IRS Form 1099 in the Participating Consumer's name for the actual value of prizes received if required by law. Sponsor has not made nor is in any manner responsible for any warranty, representation, or guarantee relative to the Prize. Prizes and Contingent Rebates are not transferable, and no substitution will be made except as permitted by law or, at Sponsor's election, for an item or payment of equal or greater value.
Prize/Rebate Funding is a launch condition only and does not limit or reduce a stated benefit or defeat a valid, timely, and verified claim after the Promotion begins.
7. CLAIM VERIFICATION; RECORDS; WINNER LIST: Sponsor may contact a potential recipient using the contact information provided and may require an affidavit of eligibility, tax form, proof of identity, age or residence, and/or other reasonable documentation. If notice is returned or the potential recipient does not respond within forty-five (45) days after attempted notice, Sponsor may treat the claim as forfeited and, if an alternate recipient is legally required or a separate Prize drawing is offered, proceed in a manner consistent with these Official Rules. Sponsor will award all advertised Contingent Rebates and Prizes to eligible, verified recipients, subject to the stated limits and the availability of eligible claims; no award will be made to an ineligible or unverified person. Sponsor may retain entry, claim, and verification records for as long as reasonably necessary for administration, audit, dispute resolution, and legal compliance. To request a copy of these Official Rules or a list of verified Prize recipients, send a request to Playably, Inc., 3242 Lincoln Ave, Honolulu, HI 96816 by March 11, 2027, identifying the Promotion name and Promotion Period. Any published list will use only the recipient's name and city/state, where permitted by law.
8. WARRANTIES AND REPRESENTATIONS: By participating, each Participating Consumer represents that: (a) the information submitted is truthful, complete, and current; (b) the consumer is eligible and is the person who submitted the entry; (c) any purchase was for personal use and not resale; and (d) the consumer will comply with these Official Rules and applicable law. No consumer is required to grant publicity rights as a condition of entry, verification, or receipt of a Contingent Rebate or Prize. Sponsor and Outerseas will not use any entrant's name, image, likeness, voice, or testimonial in advertising or marketing unless the entrant gives separate, optional written consent, which is not a condition of entry, verification, or payment. The recipient list described in Section 7 is the only exception and will show name and city/state only.
9. GENERAL CONDITIONS: Sponsor, Brand Partner, the owner or operator of any Approved Event Source, and each of their respective parents, subsidiaries, affiliates, licensees, advertising and promotion agencies, distributors, retailers, and social-media platforms used to advertise the Promotion (collectively, the "Releasees") are not responsible and shall not be liable for late, lost, incomplete, illegible, misdirected, postage-due, or corrupted entries; interrupted or unavailable networks, websites, servers, payment systems, email, or communications; unauthorized human or technical problem or intervention; or events beyond Sponsor's reasonable control, including severe weather, natural disaster, labor disruption, governmental action, changes in law, cyberattack, fraud, or technical failure. Sponsor may cancel, suspend, or modify the Promotion only when reasonably necessary to address such circumstances or a brand partner's failure to fund or perform, or to protect the integrity of the Promotion and will, where practicable, provide notice and administer the Promotion in accordance with these Official Rules. Sponsor may disqualify a person who tampers with the entry, claim, event-measurement, or payment process, submits false or altered information, uses automation or multiple identities, or acts to harass, abuse, threaten, or disrupt another person. By entering, a consumer releases the Releasees from claims arising solely from the administration of or participation in the Promotion, but not from fraud, willful misconduct, gross negligence, or liability that cannot lawfully be released or limited. Except as expressly stated in these Official Rules, and except for Outerseas to the extent it participates as the seller, advertiser, contracting partner, or co-administrator of the Promotion, this Promotion is not sponsored, endorsed, administered by, or affiliated with the National Weather Service, Facebook, Instagram, TikTok, or any other platform used to advertise it; those entities are not responsible for the Promotion. If a social-media platform is used, entry is not conditioned on posting, sharing, tagging, or granting that platform access to personal information. All applicable federal, state, and local laws apply.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE RELEASEES AND THEIR RESPECTIVE AGENTS AND REPRESENTATIVES WILL NOT BE LIABLE FOR DIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS, ARISING OUT OF THE PROMOTION. SPONSOR'S TOTAL LIABILITY ARISING OUT OF THE PROMOTION WILL NOT EXCEED THE GREATER OF (A) THE VALUE OF THE SPECIFIC CONTINGENT REBATE OR PRIZE CLAIMED BY THE CONSUMER OR (B) [DOLLAR CAP, IF ANY], EXCEPT TO THE EXTENT LIABILITY CANNOT LAWFULLY BE LIMITED. THE PROMOTION WEBSITE, APP, AND ANY EVENT DATA ARE PROVIDED "AS IS" WITHOUT WARRANTIES BEYOND THOSE THAT CANNOT BE DISCLAIMED BY LAW. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME LIMITATIONS MAY NOT APPLY.
10. GOVERNING LAW; INDIVIDUAL CLAIMS: Except where prohibited by applicable law, these Official Rules and any dispute arising from the Promotion, a Contingent Rebate, or a Prize will be resolved individually, without regard to any form of class action, and exclusively by the appropriate court located in California and under applicable California and USA laws, without regard to conflict of laws rules. Any court proceeding must be brought individually in the state or federal courts located in Orange County, California, unless applicable law permits or requires another forum. No consumer may bring or participate in a class, collective, representative, consolidated, or private-attorney-general proceeding to the extent such waiver is permitted by law. This waiver does not limit a consumer's right to pursue an individual claim or any non-waivable statutory remedy. If a court finds any part of this Section unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law. No consumer may recover punitive, incidental, consequential, or multiplied damages or attorneys' fees except to the extent such damages or fees cannot lawfully be waived. These Official Rules govern disputes between Sponsor and entrants about the Promotion. The Playably Terms of Service govern only Sponsor's relationship with its business customers and do not apply to entrants.
11. PRIVACY AND MARKETING: Entrant Data submitted or collected in connection with the Promotion will be used to administer entries, verify eligibility, process claims and payments, prevent fraud, maintain records, and comply with law, in accordance with Sponsor's Privacy Policy located at https://playably.ai/policies/privacy-policy. Operational communications about the Promotion may be sent without separate marketing consent where permitted by law. Promotional emails, texts, or other marketing communications require separate consent where required and are not a condition of entry, purchase, or receipt of a Contingent Rebate or Prize. Sponsor may use service providers to process Entrant Data for these purposes.
12. SEVERABILITY; HEADINGS: If any provision of these Official Rules is unlawful, void, or unenforceable, it will be severed or limited to the minimum extent necessary, and the remaining provisions will remain in effect. Headings and captions are for convenience only and do not affect interpretation.
